Troy Anthony Davis (born October 9, 1968) is a death row inmate convicted of the August 19, 1989, murder of Savannah, Georgia, police officer Mark MacPhail. MacPhail was working as a security guard at a Burger king when he intervened to defend a man being assaulted in a nearby parking lot—Davis was convicted as the assailant. During Davis’ 1991 trial, many witnesses testified they had seen Davis shoot MacPhail, and two others testified that Davis confessed to them. Although the murder weapon was not recovered, ballistic evidence presented at trial tied bullets recovered at or near the scene to those at another shooting in which Davis was also charged. Davis was convicted of murder and various lesser charges, including the earlier shooting, and was sentenced to death in August 1991.

 

Troy Davis is scheduled to be executed September 21 in Georgia despite strong evidence of his innocence. The Georgia Board of Pardons and Paroles has denied his request for clemency, and we’re calling on Chatham County District Attorney Larry Chisolm to seek a withdrawal of the death warrant.

A Georgia judge has refused to halt the execution of death row inmate Troy Davis after a last-minute appeal by his attorneys.

Davis' attorney Brian Kammer said a Butts County Superior Court judge on Wednesday rejected an appeal by Davis.

Davis is scheduled to die today at 11am, NZ time, for the killing of off-duty Savannah officer Mark MacPhail.

His attorneys filed an appeal earlier in the day, US time, challenging ballistics evidence linking Davis to the crime and eyewitness testimony identifying Davis as the shooter. They say the evidence was "egregiously false and misleading."

Pope Benedict XVI has also weighed in, asking that Davis' life be spared. Prosecutors have stood by their case.

Davis' lawyers have long argued Davis was a victim of mistaken identity. Prosecutors say they have no doubt that they charged the right person with the crime.

 

Amnesty USA.

Death penalty supporters like Bob Barr, former Texas Governor Mark White, and former FBI Director William Sessions also support clemency in this case, for the same reason. And at least three jurors from Davis’ trial have asked for his execution to be called off. Putting Troy Davis to death would be a grave injustice to those jurors who believe they sentenced Davis to death based on questionable information.
